Lambda Legal continues their fight for 'mo rights

Lambda Legal has filed a lawsuit against Uniondale Union Free School District on Long Island, NY, because the school system has refused to extend retirement health benefits to the spouse of a gay employee.

The story: 20+ year employee Duke Funderburke married his partner of 42 years, Brad Davis, in Ontario, Canada, where such unions are allowed. When the newlyweds returned to the 'Island of Great Length,' Duke requested that his benefits be extended to his new spouse, just as benefits are extended to other married retirees. The school district refused, because Brad has a penis.

Enter Lambda Legal.

Last month, the peace-loving crew served the school district with 'notice of claim papers indicating that a lawsuit would be filed if the matter was not resolved within the 30- day grace period.' The district ignored the attempt, forcing LL to step up their game and file the full-blown lawsuit, in which they argue that in denying Mr. Funderburke's request, the school district violated its 'contractual, statutory and regulatory obligations, as well as common law and the state constitution.'
